Anayasa mahkemesi kararı!!!!

Siteye şöyle bir göz attım fakat hayal kırıklığına uğradım. Biz doktorları çok ma çok ilgilendiren bir konu olan ''ta m gün yasası'' hakkında olan gelişmeler üzerine bir yazı bulamadım. 13.05.2010 tarihinde anayasa mahkemesinde CHP itirazları sınucu görüşüldü ve Yasanın iptali gerekçesiyle esasen görüşme kararı alındı. Bu konuda bilgilendirme yazısı o beğenilmeyen dershane güdümünde olan forum sitesinde dr olanda yer alıyor ama burada yok. Bence orayı kötülemek yerine bu siteyi daha ''tıklanabilir'' hale getirmek gerekiyor. Anayasa mahkemesi ne karar verdi sorusu aklıma gelince direkt o siteye girdim baktım. çünkü alışkanlık haline geldi.

Anayasa Mahkemesi, 13 Mayıs 2010 Perşembe günü Tam Gün Kanununu görüştü. Görüşmede, davanın esastan incelenmesi kararı alındı. Yürütmenin durdurulması kararı ise esasın incelemesi aşamasında ele alınacak.

Bu, ne anlama geliyor?

Bir davanın görülebilmesi için kimi şartların gerçekleşmesi gerekiyor. Bu şartlar gerçekleşmemişse dava, görüşülmeye başlanmaz. Anayasa Mahkemesinde görülen davalar için de bu kural geçerlidir. Daha önce Anamuhalefet Partisinin sunduğu dava dilekçesinde kimi şekli noksanlıklar tespit eden Mahkeme, bunların tamamlanması için 15 günlük bir süre vermişti. Anlaşılan bu noksanlıklar giderilmiş ve dava özü itibari ile görüşülebilir hale gelmiştir.

Mahkemenin esastan görüşme kararı, Tam Gün Kanunu Anayasada gösterilen temel haklarla çelişir mi çelişmez mi meselesinin incelenmeye başlandığı anlamına gelmektedir.

Şimdi sıra raportörün esasa ilişkin incelemesinin sonuçlarını içeren raporunu hazırlama aşamasına gelmiştir. Raporun ne kadar süre içinde hazırlanacağı Mahkeme heyetince belirlenmektedir. Bu konuda raportöre ne kadarlık bir süre verildiği tarafımızca bilinmemektedir.

Bu safhada yürütmenin durdurulması talebi de incelenecek.

Yürütmenin durdurulması kararı konusunda kanunla öngörülmüş standart bir süre bulunmamaktadır. Konunun önemine, aciliyetine, kamuoyunun beklentisine göre bu süre değişebilmektedir. Örneğin, son olarak, Suriye sınırındaki mayınların temizlenmesine ilişkin kanun 17 Haziran 2009’da yayımlanmış ve yürürlüğü 20 Temmuz 2009 tarihinde durdurulmuştur. Buna karşılık askere sivil yargı yolunu açan kanun değişiklik 9 Temmuz 2009 tarihinde yayımlanmış, yürürlüğü ise 21 Ocak 2010’da durdurulmuştur.

Sağlıkla ilişkili konuların görüşüldüğü davalarda da durum benzerdir. Sağlık Bakanlığı taşınmazlarının satışına ilişkin kanunun yürütmesinin durdurulması kararı yaklaşık 5 yılda, Mecburi Hizmet Kanununun yürütmesinin durdurulması kararı (ret) ise yaklaşık 40 günde verilmiştir.

Tam Günde kısa vadede yürütmenin durdurulması kararının çıkması oldukça güç görünmektedir. Kanımızca bu konuda en erken sonbaharda bir karar verilebilir.

Özetle, Mahkemenin esastan görüşme kararı davanın açılması sürecindeki noksanlıkların tamamlandığı ve yargılama sürecinin başladığı anlamına geliyor. Bu süreçte hem yürütmenin durdurulması hem de esas hakkında (nihai) karar verilecek.

Ayrıca, Mahkemenin dünkü oturum gündeminde Sağlık Bakanlığı hastanelerinde çalışan hekimlerin durumunun yer almadığı ortaya çıktı. Bu konuda önceki açıklamalarımız maalesef doğrulanmış oldu. Yani şu an Anayasa Mahkemesi gündeminde sadece üniversite öğretim üyesi hekimlerin serbest çalışma hakları görüşülüyor. Devlet hastanesi çalışanları için açılmış bir dava bulunmuyor.
